Terms of service
1. Who we are
These terms are between you and [Legal entity name to be confirmed], [Registered address to be confirmed] (“Penduses”, “we”, “us”). You can reach us at hello@penduses.com. “You” means the person or business that orders the service.
2. The services
Penduses offers two self-service services, described on our website:
- Static egress: a dedicated outbound IPv4 address, reached through an authenticated HTTPS proxy (HTTP CONNECT inside TLS) or through WireGuard. Starter includes one address in France (GRA) or Germany (LIM), as you choose when you order. Pro includes two addresses, one in each.
- IP Tunnel: routed public IPv4 addresses (a single IP, a /29 or a /28) delivered over WireGuard, geolocated in France (GRA) or Germany (LIM), as you choose when you order.
The plan descriptions and allowances on the website at the time you order form part of these terms. Managed /24 leases are governed by a separate written contract, not by these terms.
3. The pilot
The services are offered in a paid 30-day pilot. During the pilot:
- an order is a pre-order until we confirm it by email; the 30 days start when your service is ready;
- the service is best effort, with no SLA and no service credits;
- support is asynchronous, by email, in business hours (Monday to Friday, 09:00 to 17:00 Central European Time);
- features, limits and prices may change, and we will tell you about changes that affect you;
- we may end the pilot or a service. If we do so for a reason other than your breach, we will refund the unused part of the period you paid for. [Owner to confirm refund wording.]
4. Your account, credentials and verification
Give us accurate contact and billing details and keep them up to date. Proxy credentials and WireGuard keys are yours to protect. You are responsible for everything done with them. Tell us straight away if you think a credential has leaked, so we can rotate it. Do not send passwords or private keys in support emails.
We may ask you to verify who you are, who your business is and what you will use the service for (know your customer). We may do so before we start a service, before we open port 25 or an open destination mode, or when we see a risk. If you do not complete a verification we may refuse, suspend or end the service. 5. Acceptable use
You must follow our acceptable use policy. If you provide hosting to others, you are responsible for what your customers do with addresses we route to you.
6. Addresses and limits
The IP addresses belong to us. You get the right to use the addresses assigned to you while your subscription is active. The location you chose when you ordered is fixed for that address; a different location means a different address. We may change an assigned address when reasonably needed, for example for network maintenance or abuse handling, and we will try to tell you first.
Traffic allowances on each plan are fair-use allowances, not unlimited traffic. If you approach or pass them we will contact you first, unless the traffic harms other customers or our network, in which case we may limit it straight away.
7. Fees and payment
- Prices are in USD per month, excl. VAT. Tax is added where it applies.
- You pay monthly in advance through our payment provider.
- If a payment fails we may suspend the service after telling you.
- We may change prices for later billing periods after giving you reasonable notice.
- You can cancel at any time. Cancellation takes effect at the end of the billing period you have paid for. [Owner to confirm cancellation and refund policy.]
8. Suspension and ending the service
If we see or receive credible evidence that you or someone using your account breaks the acceptable use policy, or that your service puts our network or other customers at risk, we may suspend the service at once and explain afterwards. For serious or repeated breaches we may end the service without a refund for the current period. You may stop using the service at any time. When the service ends, we disable your credentials and take back your addresses.
9. Privacy
How we handle personal data is described in the privacy policy. We do not inspect the content of your traffic. For static egress we keep connection metadata for 30 days.
10. No warranty
During the pilot the service is provided “as is” and “as available”. We do not guarantee that the service will be uninterrupted or error-free, or that any third party will accept or refrain from blocking our IP addresses.
11. Liability
Nothing in these terms limits liability that cannot be limited by law. Apart from that, we are not liable for indirect or consequential loss, and our total liability for claims arising from the service is limited to the fees you paid in the three months before the claim arose. 12. Changes to these terms
We may update these terms. We will email active customers about material changes before they apply to you.
